In these Terms & Conditions:

  • "Service" or "Services" refers to the highland property rental guidance and consultation services provided by Cascade Living.
  • "User," "You," or "Client" refers to individuals or entities engaging with our services.
  • "We," "Us," or "Our" refers to Cascade Living.
  • "Website" refers to the Cascade Living website and associated digital platforms.
  • "Agreement" refers to these Terms & Conditions and any service agreements entered into.
  • "Property" refers to highland rental properties presented through our services.

2. Acceptance of Terms

By accessing our website, submitting inquiry forms, or engaging with our services, you acknowledge that:

  • You are at least 18 years of age or have reached the age of legal majority in your jurisdiction
  • You have the legal capacity to enter into binding agreements
  • You agree to comply with all applicable Thai laws and regulations
  • All information you provide is accurate and truthful

If you are engaging our services on behalf of an organization, you represent that you have authority to bind that organization to these terms.

3. Service Description

Cascade Living provides the following services:

  • Highland property rental consultation and guidance
  • Property matching based on client preferences
  • Coordination of property viewings with owners

  • Community connection and wellness resource introductions
  • Post-settlement support services

Our services are advisory in nature. While we provide careful guidance and support, final decisions regarding property selection and lease agreements remain your responsibility. We facilitate connections between clients and property owners but are not parties to rental agreements.

4. User Responsibilities

Acceptable Use

You agree to use our services in good faith and for lawful purposes only. You will not:

  • Provide false or misleading information
  • Engage in fraudulent or deceptive practices
  • Violate any Thai laws or regulations
  • Interfere with property owners or other clients
  • Misuse confidential information shared during consultations

Information Accuracy

You are responsible for ensuring that all information you provide regarding your property preferences, timeline, budget, and personal circumstances is accurate and current. You agree to promptly notify us of any changes that may affect our service delivery.

Independent Verification

While we conduct thorough property assessments, you are responsible for conducting your own due diligence regarding any property before entering into a rental agreement. We encourage you to verify property conditions, legal status, and suitability for your needs.

5. Service Fees & Payment

Service fees are clearly outlined for each service tier and will be communicated during your initial consultation. Payment terms include:

  • Fees are payable in Thai Baht (฿) unless otherwise agreed
  • Initial consultation fees are due prior to service commencement
  • Additional service fees are outlined in individual service agreements
  • Payment methods include bank transfer, cash, or other agreed methods

Refund Policy

Fees for consultation services are non-refundable once services have commenced. If you are dissatisfied with our services, please contact us to discuss the matter. We will work with you in good faith to address concerns and may offer alternative solutions on a case-by-case basis.

6. Intellectual Property

All content on our website and in our service materials, including text, graphics, logos, images, and software, is the property of Cascade Living or our licensors and is protected by Thai and international intellectual property laws.

You are granted a limited, non-exclusive license to access and use our website and service materials for personal, non-commercial purposes related to your property search. You may not:

  • Reproduce, modify, or distribute our content without permission
  • Use our branding or materials for commercial purposes
  • Remove copyright or proprietary notices from materials

7. Disclaimers

Our services are provided on an "as is" basis. While we strive for accuracy and quality in all aspects of our service:

  • Property conditions may change between viewings and move-in
  • Community and neighborhood characteristics are subject to change
  • We are not responsible for property owner decisions or actions
  • Environmental assessments reflect conditions at time of evaluation

We provide guidance and support but do not practice law or provide legal advice. For legal questions regarding rental agreements, please consult a qualified attorney licensed in Thailand.

8. Limitation of Liability

To the maximum extent permitted by Thai law, Cascade Living shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Disputes between clients and property owners
  • Property conditions or owner representations
  • Changes in neighborhood or community characteristics

Our total liability for any claim arising from our services shall not exceed the total fees paid by you for those specific services.

9. Indemnification

You agree to indemnify and hold Cascade Living, its staff, and affiliates harmless from any claims, damages, losses, or expenses arising from your use of our services, your violation of these terms, or your violation of any rights of third parties.

10. Termination

Either party may terminate the service relationship with reasonable notice. Specific termination terms include:

Termination by Client

You may discontinue services at any time by providing written notice. Fees for services already rendered are non-refundable.

Termination by Cascade Living

We reserve the right to terminate services if you violate these terms, provide false information, or engage in conduct we deem inappropriate or harmful to our business relationships.

Effect of Termination

Upon termination, your right to use our services ceases immediately. Provisions regarding confidentiality, intellectual property, and liability shall survive termination.

11. Dispute Resolution

Governing Law

These Terms & Conditions are governed by the laws of the Kingdom of Thailand. Any disputes arising from these terms or our services shall be subject to Thai jurisdiction.

Informal Resolution

In the event of a dispute, we encourage you to contact us first to seek informal resolution. Many concerns can be addressed through open communication and mutual understanding.

Jurisdiction

If informal resolution is unsuccessful, disputes shall be resolved through the appropriate courts in Chiang Mai Province, Thailand. Both parties consent to the exclusive jurisdiction of these courts.

12. General Provisions

Entire Agreement

These Terms & Conditions, together with any service agreements and our Privacy Policy, constitute the entire agreement between you and Cascade Living regarding our services.

Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be modified to reflect the parties' intention or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these terms shall not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer your rights or obligations under these terms without our written consent. We may assign our rights and obligations without restriction.
